2008年12月15日，美国国际贸易委员会应飞索半导体公司（Spansion, Inc.）和飞索半导体有限责任公司（Spansion LLC of Sunnyvale, CA）的申请，对部分动态随机存储集成电路及同类产品启动337调查，涉案产品主要用于USB驱动器、数码相机、电话、音乐播放器和电脑。 2008年11月17日，美国飞索半导体公司（Spansion, Inc.）和飞索半导体有限责任公司（Spansion LLC of Sunnyvale, CA）提出对涉案企业发起337调查的申请。原告诉称，出口到美国并在美国国内市场销售的上述涉案产品侵犯了其专利权，要求美国国际贸易委员会发布普遍排除令和禁止令。 在本案中，美国国际贸易委员会最终确定以下企业作为本案的被告： （1）三星电子有限公司（Samsung Electronics Company, Ltd. of South Korea）； （2）三星电子（美国）公司（Samsung Electronics America, Inc. of Ridgefield Park, NJ）； （3）三星国际公司（Samsung International, Inc. of San Diego, CA）； （4）三星半导体公司（Samsung Semiconductor, Inc. of San Jose, CA）； （5）三星通信（美国）有限责任公司（Samsung Telecommunications America, LLC of Richardson, TX）； （6）苹果公司（Apple, Inc. of Cupertino, CA）； （7）中国台湾鸿海精密工业股份有限公司（Hon Hai Precision Industry Co., Ltd. of Taiwan）； （8）中国台湾华硕电脑公司（AsusTek Computer Inc. of Taiwan）； （9）华硕电脑国际公司（Asus Computer International Inc. of Fremont, CA）； （10）金士顿科技有限公司（Kingston Technology Company, Inc. of Fountain Valley, CA）； （11）金士顿科技（上海）有限公司（Kingston Technology (Shanghai) Co.
